    Photo radar ticket - California

Anyone with experience on the strategy of ignoring a ticket from a photo radar unit? This was for a illegal right turn on red.

I red a long article in the OC Journal that said they are widely ignored and authorities have neither the will or the resources to pursue violators.

They don't enforce traffic violations with cameras yet in my state so Im not sure. I guess California's traffic court is flooded with cases just like yours.

    Watch this video first.

"It is extremely easy to beat this type of ticket in court. Your easiest defense is to simply throw the ticket away. If it does not come with a return receipt that requires a signature, there is no proof that you actually got the ticket and they cannot prosecute you on that. What the legal system wants you to do is just send in the fine and not ask any questions. This can be a big money maker for some communities. One other form of defense to utilize on your behalf is the fact that when you are accused in court you must be faced by your accuser. Obviously the computer cannot appear in court as a defense method for the prosecution. Also, you do not have to identify yourself as the driver of the vehicle because it would violate your sixth amendment rights against self incrimination."

How to Beat a Speeding Ticket - Free Ebook download by attorney Norman G. Fernandez at BikerLawyer.net

Read your state's Rules of Civil Procedure, Rule 4, Service of Process, to verify this for yourself. "Personal service of process" requires handing to to you in person, or mailing it to your home with a signature FROM YOU proving receipt. Showing up in court is for illiterate slaves. Once a defendant makes a "general appearance", the court gets jurisdiction over the sucker.

These are the easiest of all tickets to win, just like parking tickets. Just throw them in the trash. If gangsta govt comes looking for you just keep appealing until you set a precedent at the supreme court level to ban all those types of tickets, as these 2 lawyers did. When these 2 lawyers appealled 150 of their own parking tickets, they lost 3 trials, then gangsta govt voluntarily dismissed all 150 tickets, removed all 100 parking meters in the town, and gave everyone free parking, rather than set a statewide precedent against mafia parking meter contractors that keep all "govt" parking profits. City of Cookeville v. Onks, 1993 WL 398472, Tenn.App.,1993

Or do what cops do, and use the ticket scameras as target practice. Apparently US cops don't appreciate being replaced by military robots from Australia, Germany, England and Communist China. Which means that prosecutors have allowed Open Season on robocop scameras, since Constitutional Equal Protection doctrine in 14th Amendment orders that when one group gets immunity (cops) then everyone gets immunity for that same act. This alleged sniper "lost" a probable cause hearing pro se without a lawyer (51% burden of proof), but the grand jury never returned an indictment.

Or you can do what 1,000s of citizens do in Europe, and set the scameras on fire, or bomb them with Thermite (which is what Uncle Scam bombed the World Trade Center with on 9/11/2001).

National Motorists Association might even pay you $5,000 to fight your photo radar speeding ticket. NMA will pay your ticket if you lose in court.

NMA requires use of this book by Nolo Press, written by lawyers, on how to win in traffic court without a lawyer. Available for either California or the other 49 states. By far the best book on the market, but even that doesn't tell you everything, so watch the next video:

There is no way that they can possibly prove that you have recieved the ticket in the mail. I wouldn't even respond to it. i would file it away in the trash can and forget about it.

    Good

You don't have to pay the ticket, but after about 60 days they will send a process server, just let your family know not to answer the door for strangers for a couple months and they can't get ya... drops after 120 days total.

A couple that swings or swaps are obviously not going to define cheating the same way a monogamous couple would.

Well, I know where I live, if you ignore the ticket long enough, they come get you. The ticket proves the car was there, entering the intersection on the red light, Then you have to prove it really wasn't you in the car, they no longer have to prove it was, and if you are found guilty, now you get the points on your licence, and it serves you darn well right.
If you just pay the stupid thing, it doesn't attach to your licence, and you get no points.
Then you learn to drive. We had one driver who was getting 2 or 3 a week at the same red light, but he refused to learn. He ended up having to pay several thousand dollars in fines before he smartened up.
