Are Funeral Expenses Tax Deductible?
We recently received at request from a close friend. If a Canadian or US attorney can please let us know if funeral expenses are deductible on a tax return we would appreciate it. The person in question spent roughly $17,000 this year on funeral expenses, are any or all of these tax deductible?

Answer
An individual who pays for the burial of a family member (or anyone, really) cannot deduct the funeral expenses from their own income for their personal income taxes. However, the individual may be reimbursed for those expenses from the estate of the deceased, and those costs will not be counted as part of the estate when calculating any estate taxes due.
This is only true of the IRS's position as upheld in the First Circuit. For an answer about state income taxes or Canadian national taxes you must contact a licensed attorney within the concerned jurisdiction.

I think they are but not full.You have to pay some tax on these expenses.We can not leave this world without paying tax.Its really time to think about this.Its really big amount which he did pay on funeral expenses.

This seems to be becoming a problem for those that are left behind. Family members wonder why our loved one didn't get a funeral plan ahead of time... These plans can pale in comparison to what a real funeral will cost. $17,000 is a lot of money.. I would need to take out a loan in order to cover this for my parents.

No I do not think they are deductible. I would check with a PA to be sure. One thing you should check is to see if there was a life insurance policy attached to there health insurance. Most polices come with $10,000-$20,000

if you are being a lucky person than am sure that your Funeral Expenses Tax will be Deductible.

Did both my parents probate in New York state.
Funeral expenses should be reimbused by the estate to the person paying for the funeral before the estate assets are dispersed, the person paying for the funeral can not deduct the expense on his personal taxes, even if not reimbused by the estate . The estate deductes funeral expense on the Federal level, which ports over at the state level, giving a state deduction.

Funeral expenses not deductible on personal income tax return; seek reimbursement
In the US, funeral expenses are not deductible on a personal income tax return. The person who paid the funeral expenses can file a claim for reimbursement from the estate of the deceased person. The funeral expenses paid out as a reimbursement will not be included in the value of the estate for purposes of determining the amount of estate taxes due, if any. I can't really say how this would be handled in Canada.
