    How can they try and sew a 7 year old

    In Canada This summer my son who is 7 years old got into a bike accident on the sidewalk with an adult woman.

    She says that my son cut her off on the sidewalk and she fell and broke her arm.
    She has no proof that it was my son, there were lots of kids there and her account of the accident makes no sence
    according to the other kids that were there. Also according to the description she gave of my son it is totally off.

    Now she is sewing my son and I for damages. I don't know what to do with this.
    Should I get my own lawyer to help with the case or should I just let the insurance take care of it.

    I am posting from memory but as I remember, a 7 year old can be sued for negligence. The reasoning is that unlike crim law, tort negligence (as in this case) does not require the element of intent...merely that Sonny be the proximate cause of the resulting damage. Therefore, a 6 month old baby or a dog or a monkey can be sued. Check with a good negligence attorney.
