    Real Estate Question?

    I have been trying to modify my mortgage for years now and have attempted to modify 3 time without success. I have sought financial counseling by HUD. My situation is unique because my lender sent me papers to sign to change my adjustable mortgage to fixed for 5 years 5.25% interest rate then in 2014 the original note will continue. I did not sign the agreement or return the paperwork to lender. The lender went ahead and made the change to my mortgage without my agreement. I have been paying the new note only because I dont want to default. My problem is I will be in the same situation that I was in before in 2014. Because they changed my note I dont qualify for modifications to my mortgage. Is this legal for them to do this, and should I pursue this. Thanks Sean
