    Conspiracy and Fraud and Perjury in a Medical Fraud Case

    Is it possible that a plaintiff attorney would conspire with the defense in a case alleging fraud against a surgeon?

    The plaintiff attorney "S.G." agreed, and did not oppose a motion to strike punitive damages. This was based on a California statue of limitations requiring a punitive damages claim against a doctor to be filed within 2 years of filing the initial complaint. (California CCP

    Yes, it's possible; you would need to speak with a legal malpractice attorney who can review the case and what happened to see if actually legal malpractice took place.

    Legal guy:

    I said fraud, not malpractice. Malpractice is negligence, fraud is intentional misrepresentation. Big difference.

    Am I allowed to name names on this forum?

    I'm not aware of any honest lawyers, seriously. I've been trying very, very diligently for a long, long time. A referral to a honest attorney in Southern California would be greatly appreciated.

    Punitive damages are extra damages that a jury awards on top of the other two types of damages. There are tremendous strategic advantages to pursuing these types of damages in your case. For example, attorneys are not normally allowed to show the jury a defendant's other prior, bad acts. But if your attorney seeks punitive damages, your attorney should be able to get this evidence in. Your attorney should look for every possible reason to obtain punitive damages because it puts huge pressure on the defendant in both discovery and at trial.

    More than just problem solvers, a lawyer can help prevent problems from even coming into fruition. While most people seek the aid of these legal eagles only when problems arise, it would be wise to have a lawyer to provide you with all the legal you need. Do not generalize and lose hope in getting a trustworthy lawyer.
