This year has been ridiculously tough. Finances are hard, but I still manage. I'm going through something scary and I stay stressed. If anyone can give e some answers it would be a real blessing.

I will be honest and say that I have been late a couple of times. Not every time, but a couple. Back in March my LandLord filed a Dispossessory Notice against me, but I didn't get the notice until he was already paid. I didn't answer because he assured me that it was alright and everything was okay. He said that he would take care of all legal matters.

Around late July and Early August I began having serious financial difficulty after having car trouble, much higher utilities, and no one buying advertisement. I was in real trouble.

One morning I received a messege on my door stating that I had only 4 days to remove my things from the home. I was hurt and afraid. I had received an official Writ of Possession 5 months after the Dispossessory. I was in a frenzy.

I couldn't just up and leave because I was struggling as it were. I asked him what I could do and he told me to pay the month of July and give a check to put on hold for August. I told him that I had nothing in the bank, in fact that account may not even be any good. I swear I kept saying it over and over, but my hands were tied and just can't move in that kind of time. Wife is nearly 8mos pregnant and the money isn't there for U-Haul and new rent.

He promised that he would not cash that check under any circumstances knowing that the account had nothing. He said that it would only be used as a promissary note. It showed good faith...etc. We had a long discussion. I was having to borrow to pay the rent, but the check part I didn't like, but my family on the streets was even worse. I went along with it.

I wrote a postdated check and he told me not to worry he keeps his promises.

I'm late again (been making payments) and now he says that he's sending the check through the DA's office. I'm getting arrested. I haven't yet been arrested, but this guy is looking to get me locked up now.

Not only that he has also said that he will be processing the eviction again. Not sure what to do. I can't even afford legal assistance. I'm messed up now huh?
