Departure While Criminal Case in courts
Hi guys
I was wanting to see if you guys could help me with a departure case.
Basically what happened is that while i was going through the immigration courts i was falsely charged with a felony. So i bonded out and the case is still pending, but the immigration case finished with a voluntary departure.
I have no problem with the finding, what i have a problem with is that I will have to leave before the criminal case is finished.
I face 2 possible felonies, one for Theft and the other for bond forfiture.
Either one of those cases basically means That i cant ever hope to get any benefits when my kids grow up or if a gues worker program comes around latter on. I need to file an appeal but i am stumped as to what law I will base my appeal with.

You may have to come back in the US on a "humanitarian visa" for purposes of disposing of your criminal case. First, your attorney would have to first set aside the warrant in the criminal case and get a hearing set. Then you would have to ask permission from the consulate to approve the humanitarian visa. These visas are only for a limited time period (a week or so) and for a limited purpose (court). Good luck.
