My friend had her creditor claim rejected by the estate. She has filed a Complaint. But, it seems she has no real legal grounds because of California statue of limitations. So lawyers she has consulted tell her. And she can't afford them anyhow
I am of the opinion that she should give up. Mostly because it is very upsetting to her and she doesn't have a case, can't win. Also, I am afraid the estate administrator will use her lawyers to start piling it on my friend, maybe get her on legal errors, as she is pro per. The administrator is a vindictive enemy of my friend and the estate lawyers will do her bidding per hour, happily.
How can she end it?
She has missed some status conferences, with the judge and I think she could just miss the next one and the judge would throw out the case. Would that work?
Or, could she file a formal "I wash my hands and walk away"?
Which is safest, to avoid retaliation, if the case continues, by the estate administrator, who has a personal ax to grind in this?
