Hi All,

I am in the process of starting a new home improvement oriented business and have a guy I want to use to do sales presentations that I am now finding out has a non-compete with his current employer.

What I guess I want to know if how well do these things stand up and are there ways to legally work around them?

The 2 companies will be in direct competition due to providing the same type of services and doing business in the same areas but we are using different business processes and materials.

I can provide more information if needed. My sales guy states he is unhappy with his current employer due to changing several processes that he must abide by which is causing him to lose sales and not make the salary he needs to support his family.
