    Question about medical leave

    Hello. I have a pretty simple question. My girlfriend recently had a miscarriage and it has been pretty tough (physically and mentally) on her. She has 2 part-time jobs. One of the jobs is kind of being harsh. Today her pains and cramps intensified greatly and some other things (internal) were not right. She called her doctor and she told her to definately stay home from work and she might have to stay the next few days if it doesn't clear up. Her doctor was willing to call in or fax a doctor's note to her employment. She said she'd call her manager. She called her manager and her manager demanded she find somebody to replace her shift. She called 3 people and they said no. Her manager said a doctor's note didn't matter, that she would still be marked as missing and it was her responsibility to get a replacement. She has only been at this job for about a month. This place is kind of strict and we re worried she might be terminated. So my question is, how far can the employer go? I know that she probably hasn't been there long enough to get the family medical leave. My concern is that they don't know the constraints of a miscarriage. She's basically right now going through the same pregnancy terms as a healthy woman but with terrible pains. If she is terminated, what are her rights, if any? Thanks

    What kind of company is that, they don't understand the situation of your girlfriend and I think it is not fair to replace him because she had only a sick and she never resigned. I think you should consult a attorney to file this case.

    Ask first the help of an HR if the HR can't help you, seek a professional help of a lawyer then get an attorney.

    That iss really really bad . In my view you she should just kick that manager .

    In my comp i get 3 Sick Leaves every months. and their are other terms also for leaves by which i can avail leave .

    That company is not good they shouldn't terminate her there should be a medical leave in that company. You should consult a lawyer to give you some advice to help in your case

    lets take it this way, medical leave is given to the employees who are stayed in company for 5 months or more. but considering the situation of the employee that is sick its still unreasonable to terminate her without any legal basis.

    No employer has right to terminate his employee just because she wants some medical leaves... As your girl friend's doctor had talked to her employer and still he is not understanding her problem then i would suggest you guys to take some legal advice on that......

    Ask your girlfriend to talk to her employment department once, if still there is the same problem then you guys can file a case against her employer...
