    divorce

    I got married in Pakistan and getting divorced in USA.What is the first step ,from where i start for getting divorced. How will I get the divorce registered in Pakistan. plz tell me thanks alot

    You'll need to consult with the laws in Pakistan regarding your marriage since it wasn't done in the US, and this form to my knowledge only handles legal matters in the US.

    Divorce ( Khulla )

    I am a Lawyer from Pakistan. Nosheen you can get divorce ( Khulla ) from Pakistani Court. According to the Pakistani Law you will appoint Special Power Of Attorney who will appear on your behalf because you are out of country. Pakistani Divorce recognize in USA.
    If you want to get Divorce in USA. You will prove that you have remained 1 year seperate from your husband through phone bills, rent deed......etc you will write a deed in which you will write alimony, child support, child custody, property settlement...................etc and you can file this deed with or without consent of your husband in your USA state family court where you are living more then 6 moth.If you want to get legal advice feel free to contact me. worshipper1981@yahoo.com

    Re dissolving a Pakistani marriage in US Courts

    Hello nosheen,

    Your first step is to see a divorce lawyer in the American state you are living in.

    However, as I read your question I interpret it to mean that you want to get divorced in the US but may have a question as to the validity of the US divorce in a Pakistani court. Only a lawyer practicing in Pakistan can tell you the validity of a US divorce in a Pakistani court-as someone else observed here, I don't think a US lawyer in this forum would be able to answer that question unless he or she is also a practicing attorney in Pakistan.

    I only practice in Florida. Florida courts will dissolve any marriage which was validly contracted elsewhere, provided you have lived in Florida for at least 6 months prior to filing your petition for dissolution; and some form of legal notice is given to the other spouse, either by personal service or through publication (which has its own set of requirements).

    The state where you live may have different requirements. As I said at the beginning, you should seek an attorney in the state you live in for specific details about how to get it done.

    You'd better see a good lawyer and go check the Pakistani divorce law as well. The Pakistan court is strict to the grounds of dissolution of marriage. You must be familiar that the Pakistan court "before passing a decree on ground (5) the Court shall, on application by the husband, make an order requiring the husband to satisfy the Court within a period of one year from the date of such order that he has ceased to be impotent, and if the husband so satisfied the Court within such period, no decree shall be passed on the said ground."

    So, once you get the divorce from US court, is it going to be islamic divorce or she has to get the khulla from somewhere. Is pakistani court (union council)going to accept this divorce from US court? what is the procedure for that??
