    Illegal Search?

    This incident occurred in Austin Texas. I have a friend who was on vacation and when he was gone some random drunk guy kicked in his door. The cops were called, entered the residence and found some contraband. They left a note and now 2 months later are threatening him with a charge. 1.) the contraband wasn't his 2.) are the police allowed to enter the property? 3.) Wouldn't the burden of proof of possession still have to happen?

    Hell for all we know the random drunk guy who kicked in his door could have dropped it or left it there.

    I have reviewed the plain sight doctrine, but unsure how it would apply in this case

    may be you have to suffer for this in future, because its not a good breach.
