Disorderly Conduct for helping friend A fight in the city, 6 men pass the man and a friend, hurling abuse, they passed and they continued to shout more as they walked away. they told them to f-off and kept walking, they came towards them and a another man who saw this from a hotel came down and asked if the two needed assistance.
eventually they came up and were confronted by them, one knocked out one friend and the man jumped in their, resulting in a 9 man brawl. Eventually police came and arrested everyone, and gave the man and his friend and rescurer a move on notice, telling them to the confines of the city, also telling them that they would not be charged with disorderly conduct.
The police officer wrote down his address wrong as 18 instead of 83. He never recieved a summons and missed the court date in november last year. two weeks ago he gets a call from a debt collector saying he owe's a $1000 fine for a court date missed. It was the first he had ever heard about any court date or charge.
He contacted the arresting officer and reminded him of the circumstances he was placed in. He rest assured he would of never "let me off for fighting", as he is normally kicking himself after when he does let people off. He also told him that it is unlikely he would Win, as the court would see it as he could have always ran away from the situation, and also if he did take it to court and lost, the costs would also increase.
He unsure what to do at the moment, and was told by legal aid, to write a letter to the magistrates court, explaining that he never recieved a summons, and basically the story told here.
