    Bad Check Defense - Ohio

    I have 5 bad checks that I wrote in the state of Ohio. All 5 checks were in the amount of $950. When I contacted the company to see what I still had outstanding with them, they told me that I did have 5 items with them. One check was $1045 (which is $950 + $95 charge) The others were in the amounts of $95, $495, $805, and $453. They said that they have turned the matter over to the police and they are going to be prosecuting me criminally. The question is because the other 4 checks have had a partial payment put on them, would that technically be considered a settlement and they cannot pursue criminal charges? (Understand that all checks were cashed for $950 each) I understand the first check has not had anything paid on it, so they could for that check only. I'm also trying to check whether they cashed the checks for me before the date posted on the checks, which would make it a post-dated check and they cannot pursue criminal charges just civil charges. Please let me know if I'm right on this, and what else should I do.

    It is a serious matter and i would suggest you to consult a lawyer and try to apologize and convince the parties that you did it unintentionally and pay the damages as soon as possible.
