Probable Cause
Hi All,
My question involves criminal law for the state of: California
My friend was pulled over for failing to come to a complete stop in a residential area. He smelled of marijuana. He has a Medical Marijuana referral from a Dr. and has intense back pain.
He was on his way to a customer after driving all day in LA. Arrested and charged with DUI - marijuana.
Just received notice from CHP of correction to ticket notifying him that they have removed the "failure to stop at stop sign" charge. He is very confused why they would do this. Ticket does not yet show up in court records.
Wasn't that the probable cause to stop him in the first place, and why remove that charge?
