Misdemenor or Felony
I was charged with a felony of grand theft with 407 dollars worth of stuff from the bookstore at ucsd. I was charged of stealing textbooks sweat shirt and a flash card. (grand theft = $400 or more, and i went 7 dollars over) This is my first time being charged with any sort of crime and i'm a student at ucsd. Most importantly, I am 19 years old and i hold a legal residency status aka green card. Do you think the DA will assign a felony arraignment or misdemeanor arraignment for this case. What are the percentage of each happening? I was arrested on 11/11/08 and bailed out on 11/12/08. My court date is 11/20/08 so i have a week to decide what to do. If i am assigned to a misdemeanor arraignment, should i plead guilty and just receive probation fines and community service? Because from what i know, misdemeanor conviction will not deport me out of US, but i heard it will affect my future chance of earning a citizenship. So i do not know if i should go for not guilty and hire a lawyer for it. Also what are my chances of getting not guilty if it was a misdemeanor arraignment. Lastly worst case scenario, lets say i get felony arraignment, I know i have to hire a lawyer to change it to a misdemeanor, because felony conviction will deport me out of US. please help me with my situation
