    Collection Agency Suing Me?

    I'm having the weirdest things happening to me lately... Nonetheless, received a letter from a "Debt Free" company today letting me know that I'm being sued by a Collection Agency (Pinnacle Credit Services, LLC), and they can assist me in the matter. At first I thought it was scam until I checked out my state judiciary site and saw that there is indeed a case against me for a little over $800.00. First and foremost I have no idea what the case is about. Pinnacle is not listed on my credit reports (eq, ex & trans), nor have I received anything in the mail nor a phone call from them.

    The court documents I saw online have my correct name but my old home address (from a year ago). The case information online doesn't say what or who it's for. Just Pinnacle Credit Services, LLC is listed as the Plantiff.
    There's a court date set for July 14th. Online it shows that a notice of the trial was sent to my old address on 4/01 and then the next line shows it was received 4/10. Which isn't true cause I haven't received anything (again, I've been at a new address for over a year now and had my mail forwarded when I moved). I haven't even received a letter from this Pinnacle about this so called debt!

    Called the court house today and was told I needed to mail them a change of address. I figured I'll just go there and make that change and hopefully be able to pick up this notice.

    I guess I'm really confused as to how a collection agency can sue someone when they don't (and have never) appeared on a credit report, or the fact I haven't received any documentation from them.

    Any advice on this would be greatly appreciated!

    Just because a debt doesn't appear on your credit report doesn't mean it doesn't exist. I would show up to court regarding this matter; regardless of the fact you probably due owe the debt and will be liable for it. Don't be like many other foolish people and blow this off.

    i agree with the other comments. you definitely need to deal with this. This is unsecure debt so there is not much they can do to you. It will just effect your
    credit for life.

    I know its not July yet but have you found out anymore information??? I'm curious to see if you "forgot" about a debt or if their truly was a flaw in the system. Like others have said, I hope you don't ignore this situation and get ahold of Pinnacle soon.

    Thanks for your advice thus far. Believe me, I did not forgotten about this nor swept it under the rug. Was able to manage a nice settlement... Case has been dismissed.

    Being sued by collection agency

    I have been served by someone from a collection agency for a medical debt....at work i might add....NOT COOL...can they do that?

    Was looking around online and found this

    Legal Process
    # A collection agency must follow a certain process before suing someone for an unpaid debt. Generally, the collection agency must first give the debtor written notice of the debt owed, called a "demand letter." Such notice must include the following: the debt amount, the name and address of the creditor, and at least 30 days for the debtor to respond either by making payment arrangements, paying the debt in full or disputing the debt. Only after those 30 days have expired without written correspondence from the debtor can the collection agency proceed with a lawsuit.

    I was never notified in any way by letter thru regular mail or certified mail.

    My question here is, can I use this in any way against this process?
