homeowner disputing invoice paid
We installed a hardwood floor for a customer and they gave us a cheque for the full amount upon completion. A few days later, they called us back to come and do some touch ups, which we did. 3 months later, now they are requesting a refund of $400.00 based on their opinion that we overcharged them. Prior to the job, they received a written estimate with all details. They are claiming that we charged too much wastage on the flooring and the trim work. We use the standard 10% waste factor that is used in the flooring industry. We have tried to satisfy them by returning a few times to do the touch ups at no charge and they are still not satisfied with that either. We offered $100 good-will gesture refund. They are refusing that and will only accept the $400 or go to small claims court.
My question is since they received a written estimate and gave us a cheque for the full amount upon completion, are they not deemed to have accepted the contract?
We are located in Ontario, Canada.
