roofer refused to do job claiming there was a mistake in the contract price
I signed a contract in mid June to have my roof redone. The estimator at the time told me the job would be started in 4- 6 weeks. After 2 months, in early August, I started to phone the company to find out when they intended to do the job. They kept saying that they were behind schedule because of the rainy weather but that they were going to get to my house eventually. Finally in early November, after having called them many more times (7x) the owner told me that the estimator had made a mistake in the price of the roof job and that he wouldn't be able to do the job for the quoted price. He wanted ~$3k more. I have tried to get another contractor to do the job now but because it is late in the season I have been unable to get one to do the job before winter sets in. Since I wanted to get this job done this year to benefit front the home renovation tax credit, can I sue the roofer for the loss of this credit? What about suing him for the difference in price I will have to pay to get another roofer? If I get a roof leak can I sue him for damages too? Since the owner of the roofing company didn't tell about the pricing mistake until almost 6 month after signing the contract is he not liable for not informing me about this in a timely fashion? Are there any other legal angles in which this roofer can be taken to task?
