Jurisdiction of the courts
What establishes jurisdiction of a court to act on a matter? Specific questions. 1. A lawyer files a suit against a debtor but makes no statement whatever about jurisdictional issues. Does not state how the plaintiff has standing to sue in that state's courts. We know that Nationally accredited (N.A.) banks have the right to sue and be sued in any court of competent jurisdiction. That right is granted them under Title 12 which is the national banking act. But in cases where the alleged plaintiff is not a national bank would jurisdiction have to be established by the Plaintiff's attorney or not and does the court have jurisdiction if the attorney does not establish the court's jurisdiction in his pleadings? If the plaintiff's attorney must establish the court's jurisdiction in his pleadings and it is required in order for the court to render judgment what law or case law or rule of procedure would allow the debtor to move the court to vacate the void judgment?
