    Chargeback Issues of Small Buisness

    My question involves business law in the state of: NY. I wanted to find out whether anything can be done about receiving chargebacks when you are selling virtual products (online service). Unlike selling an actual item we are offering a service that is rendered online and for the past month have started to receive numerous chargebacks from users who even sent out a copy of their driver licenses or passports. Most of the chargeback reasons as seen from the merchant provider is: Fraudlent - unrecognied transaction. Is it possible to win a dispute if you have a copy of user's information. Or what do you recommend to do at least to decrease the amount of chargebacks like these, be aware that all of them come from users who reside in non US countries. Let me know your suggestions.

    Fraud chargebacks can be divided into "unrecognized transaction" and "confirmed fraud" so to say. If you receive fraudelent "unrecognized" chargeback this means you haven't responded RR sent by issuer bank. Proper fulfilment of RR usually saves from such kinds of chargebacks. Usually it's possible to win dispute if you realy have user's information but this depends on several factors such as your processing, payment systems (visa, mastercard etc.), transaction amount, secured/non-secured transaction etc. More definite answer requires a little more information you've provided

    your funds aren't truly available until the check is settled between your bank and the other party's bank. If your bank makes a certain amount available to you earlier than that it is technically a loan to you. It's actually rather complicated. But the bottom line is that to truly be able to use funds on a check you deposit, you need to wait for the check to settle. In this case, you had outstanding checks clear against unsettled funds.
