    Wrongly accused of hit & run by police

    Hello, I need some help/advice with a situation.

    My car was struck by another vehicle which left the scene. However police are accusing me of striking the other vehicle. The other vehicle and it's occupant(s) are nowhere to be found.

    I parked one of my cars,(I own 2) on Tuesday 7/6/10 at around 5pm 3 blocks away from my apt. I moved my car to Bay St because of Vicente Terrace Street Cleaning on Wednesdays from 8am - 10am. I have been following this routine since moving to Vicente Terrace in November of 2001. I had not driven or even been near that car since I parked it Tuesday, 7/6/10 at around 5pm. My car was parked on Bay Street at around 5pm on Tuesday 7/6/10 and remained parked until it was towed without my knowledge or consent on Thursday 7/8/10 at around 8:45pm.

    On 7/8/10 I came home from work (on bicycle) at around 4pm and I remained in my apt until 7:45am 7/9/10. My internet history records show exactly what sites I was on at the time of the accident. I can also tell when I stopped looking at my computer because police showed up at my door and I spoke with them.

    I was in my apt for about 6 straight hours when on 7/8/10 at 10:15pm 2 officers showed up at my door telling me 2 hours ago I was driving my car, made a right turn hitting another vehicle and left the scene. They also told me my car was towed to the impound lot and I could not see it until I talked to the traffic accident investigator. The officers also told me the investigator would contact me in 2 days which he never did. One officer blatantly told me he "Personally thinks I hit the other car and walked home". I was not cited or charged with anything.

    At the time my vehicle was hit, a customer was inside a liquor store across the street and heard the accident noise. He came out to look and saw 2 unoccupied parked cars. Mine with damage to the front and a silver/gray Toyota Forerunner with minor damage to the rear. According to the police report the "witness" who did not see the accident or myself called police and said my car had just struck a vehicle.

    The "witness" told police he saw a suspicious looking person walking away looking over their shoulder but gave no description of this person.

    When police arrived on the scene only my car remained.The silver/gray Toyota Forerunner was gone from the scene. Police located me through my license plates.

    I received a notice of stored vehicle on 7/10/10 and written on it and at the top was written "Hold for 48 hours for hit and run investigation". It has now been 9 days since my car was towed to the impound lot. And I have not been allowed to see it nor heard anything from the crash investigator as of the time of this writing.

    After many attempts to contact the investigator by phone and at the police station, I finally talked with him, (Officer Green) who simply said, I'll give you a call if I have any questions" and hung up. I tried calling back within minutes but there was no answer.

    It also took a couple days of trying before I could get a copy of the police report. I was told I needed the ok from the investigator. I did finally receive a copy and I dispute what is on this report.

    I tried to file a hit and run but was rejected because police think I am the hit and run driver. I will go down there today again and try to file a hit and run report.

    I am wondering what I am supposed to do at this point. My car is racking up fees I cannot afford to pay. I talked to a lawyer who charges for one hour what I earn in a week.

    Can I demand to know what is going on with the investigation? The investigator does not return calls and only once in many attempts have I reached him on phone. I don't even know if he has looked at my car yet. Should I get a lawyer? If so what would they do at this point for me? Do I just sit and wait around for the investigator to contact me? I was told I needed to make an appointment with the investigator but when I talked to him he did not make any appointment with me.


    I am the victim of a hit and run accident yet police accuse me of being at fault.

    If you were at home for 6 straight hours when police showed up at your door and said, "2 hours ago you were driving , you hit someone's car and walked away" and your car was towed to impound and remained for 8 days, what would you do? What CAN you do?

    Any advice is desperately appreciated!

    Find out online law firms and post your problem there too, they provide free legal guidance without the cost of attorney.

    It seems you need a car accident expert lawyer to help you defend yourself from being accused of hit and run accident. Just keep all the data that you can use as evidence. I'm sure you will win the case.

    just visit some criminal lawyer related to this case,and teach a lesson to the police as this happens a lot all over the world even one of my friend have an experience with the same situation and atlast he consulted a lawyer and he got justice and money
