    Car Accident in Parking Lot

    We were recently in a car accident in a parking lot and the police were called. They came out and made a report as well as spoke to a witness. They claimed that the other driver was contributing factor to the accident while we were not. We had to wait till Monday to speak with the other persons insurance when we called them they are saying that since their client is saying it is not their fault they are not responsible, we asked if the witness or the police report had any value and they said that since it was private property the police have no jurisdiction. Is this true or is there anything we can do to get the police report and the witness to help our case

    The insurance company is bluffing.
    While it is true that police will not give traffic citations for violations in private parking lots, that does not mean that the police report is irrelevant.
    The police report documents what the officer found at the scene and what people said. It also gives the officers opinion about who was at fault. The officers opinion is valuable but not binding on the insurance company.
    Sounds like your going to have to fight it on the issue of liability. To do that, you need to get the witnesses testimony and the police officers testimony as well as your own. At that point it will be 3 against 1 and you ought to have a good shot at winning.

    As an insurance adjuster I take offence at how this insurance co. is treating you. The police report is a tool, and so is the witness statement that we use every day to make liability decisions. I would recommend that you contact your insurance co. Your adjuster will contact the other insurance co. and try to get it worked out for you. You may end up having to use your own coverage and pay your deductible. Then your insurance co. can take the other one to arbitration and try to collect back their money and yours. The process may take some time, but it should work out in the end.

    I think if you have witness and FIR report then you can claim for your compensation . you can try for it.

    Testimony of the police officer, the witness and yours will do. You have to get those and present to the company. I think you have the fight, but I don't guarantee you, if the insurance co. is strict about this, then you won't get. But, as your right is concern. just try for it.

    The problem is they did not notice,who will be the responsible in this car accident. If some lawyer studies the investigation, it might be some of the police are had a testimony, it can't be done for it.     What insurance company person is saying is totally wrong....

    Really to hire the lawyer is all depends upon the situation if the situation is going worse then one should advice to hire a lawyer to control the situation.
