I had a car accident where I was rear ended at a red light. Obviously the other person's fault. No police report were filed because I know the person who hit me. I got a whiplash injury and followed a treatment worth about $4000. The car damages were $1000. The insurance claims that it is only a minor impact so they do not expect to reimburse anything for my medical bills (they already paid for the $1000 of the car damages). Even after the treatment I have permanent damage on my neck (soft tissues).

Always file a police report after an accident. You definitely should have filed a police report even if you knew the person. If you already accepted a settlement offer from the insurance company you are screwed.
