I feel like it's a tough case to prove. Although I sympathize with the loss of your pet, how can you really prove in court that the car was speeding?

First of all I deeply sympathize with the loss of your pet...but how are you going to prove that the car was wrong?Your dog also ran into the car isn't it?

Unless your animal was hit on private property you really have no case; the animal isn't considered a pedestrian and doesn't fall under specific driving laws. Your pet should of been leashed and not in the middle of the street. I'm sorry for your loss, but this would be considered the owners fault and not the drivers.

I also do not see any case here...and there are also strict guidelines for the pets to move around...you will not get clearance there and if it is not a private vehicle...difficult to prove...try it anyways.

You might be able to sue for pet grievance. I have heard of this before but have not heard of any out comes. But i would look into it if i were you. Because you did suffer a loss. BTW i am sorry for your loss, pets do become a part of the family.

Most localities have stringent leash laws - so stringent that even your licensed dog may be taken to the pound and destroyed in a few days if not promptly claimed. And you get socked with fines, regardless.

If your dog was off his leash and he was hit, it is highly unlikely the driver will be cited. It is highly likely that you, however, will be found in violation of your local leash laws.

This is not to say I am unsympathetic towards you. I am horrified by the loss of your dog. This is the reason for leash laws, to save us the horror and heartache of losing a beloved friend.
