Can I separate from my partner and stay in Australia?
I am an immigrant to Australia from the U.S. on a 457 de facto visa, as my husband is currently being sponsored by his company. I am employed, but do not have sponsorship.
We are talking about separating and I am looking to move into a new apartment. We plan to remain legally married unless a divorce becomes absolutely necessary. Is this legal given my visa status? Can I still live and work in Australia if we are not living at the same residence? (For what it's worth, my name is still on his lease.)
What are the legal ramifications? Could I be deported? Does any of this affect him, or is he in the clear?
