Sexual Assualt My son met a girl that claimed she was 18, he was 26. The girl was 15 at the time, but seriously looked 19! I have pictures.
She got pregnant and said it was my son’s child. She said she was and stocked him like was deeply in love with him.
Her mother forced my son to take care of her with threats of 24 year jail time if he didn't. Every time the girl got upset with my son, her mother would remind him of jail and registration as a sex offender.
They lived with my husband and I for several months. After the baby was born, he looked NOTHING like my son. I bought a DNA kit and we sent it off to the lab, it came back not his son.
The mother got angry that we did that and filed charges on him. He agreed to a plea deal by his attorney on a sexual assault charge. We found out it automatically labeled him as aggravated sexual assault on a minor.
How can I help him not have to register the rest of his life? He takes responsibility for his actions, but she was deceptive as well. She lied about her age and she was pregnant BEFORE he had relations with her.
Please help.

But for the rest of the readers. Contact an attorney BEFORE it gets to this. Your only option is to attempt to vacate his sentence and/or appeal. Find an attorney in your area and seek a time to meet to discuss options. Good luck.

Sexual assault can really prove dangerous for girls.So i think it should be something for which we can fight against.

Unfortunately, a guilty plea is the same as a conviction. Your son had an attorney, so he can't say that he didn't know what he was doing. The only argument your son can make is that his council was incompetent. And (I'm not sure about this) I think that only works if the council was a public defender that was provided by the state. If your son had a private attorney, then its his fault for hiring some one who didn't think to inform him of the repercussions of his plea bargain. Honestly, if the girl was 15, that's a MAJOR felony. He's lucky he wasn't charged with statutory rape and sent to prison. Unfortunately, (at least in my state) statutory rape is a "strict liability" offense. That means it doesn't matter if she lied. It's still the older persons fault. Period.

It's so important to find out ALL of the consequences of a guilty plea before agreeing to one. You would be surprised how often a defense criminal lawyer tells a client the punishments associated with a plea after it happens. Did you have a court appointed attorney, or was this a private attorney? Like someone said previously, it would be a stretch to argue that you had incompetent counsel, but worth a shot. Even though this situation is a major bummer, the courts usually don't look favorably on inappropriate sexual relations.

You have to file counter affidavit against the sue being filed with your son.. The girl has something to do that may result for the case to be ineffective.

Haven`t you notice the month that that girl carry her baby, and the month that your son and her meet each other? You must know that, you can DNA test on the hospital for court appeals and for evidence.
