    What constitutes Criminal Fraud in California

    I am a victim of fraud, and was conned out of my life savings. I have tons of evidence against the perpetrator, and have already won not only a dismissal against the perp in an adversarial bankruptcy court but also a judgment against him in adversarial bk court for over 100K because the fraud was so apparent. I went to the police department to file charges. I was told by the police dept (a deputy, not a detective) that the fraud is a civil matter and not a criminal matter. So, what is it that makes the fraud criminal and not just civil? I insisted that I get a DR # from the deputy as the statute of limitations is up on sunday/monday. The deputy said that I can get a copy of her report and tell her if she left anything out, willl i still be able to add info to this after the statute of limitations is up, before this gets to a detective? She did not take any of my evidence ( I have over 3000 pages of evidence) I live in California

    You can initiate a criminal investigation by either going to a police office, but also by going to the prosecuting attorney's office.

    You can try the District Attorney's (DA's) office in your city/county, or try at the state level.

    If you're thinking of going through such deceit to get a car, you can't afford it. You're supposed to mention all sources of income to your lender. They learn of your business income from your tax return information plus your receipts. If you withhold such information, you could be charged criminally with fraud. The lender can also sue you civilly.
