Hate Crime Can an advocacy group, in this case Hispanics Across America, sue the parents of teen-aged criminals for lack of "moral responsibility" in a hate crime killing? The group wants to sue the parents for a crime their sons committed, killing a Hispanic man who provided money for his family living in his home country of Ecuador. The lawsuit would seek damages for the family, as they are deprived not only of their family member but of their income. Does the advocacy group have standing to sue? The teens have yet to be tried for the alleged crime. Or would it simply be the victim's FAMILY suing, with the group as their legal representative? And is "moral responsibility" feasible to sue for in NY state?

Hate crimes (also known as bias-motivated crimes) occur when a perpetrator targets a victim because of his or her membership in a certain social group, usually defined by racial group, religion, sexual orientation, disability, ethnicity, nationality, age, gender, gender identity, or political affiliation. In theory, you can sue anyone for anything; however if this would have moral ground and stand in trial is a whole different basket of apples. I don't see why the civil suit couldn't be brought forth... the question is would it win in court.

i agree with the last comment. The thing about it is that you can sue anybody for anything if you want to.

I dont agree. You cant sue anyone for anything. Thats really not the case at all. The best place to see the common myth played out is in common court.
Watch one of these court shows and everyone sues for emotional distress. This wont be part of an attorneys claim. He can be sanctioned for a claim lacking in basis in law or theory. They dont sanction people on tv because they arent lawyers and because its a game show of sorts.
I dont believe your asking if you can file anything against anyone. You can but you are subject to sanctions if your an attorney. You are also if you are not but there is a lot more leeway.
This case may have merit and will likely be brought by the victim backed by the organization.Chicago criminal defense lawyer

Would you believe that 45 states and the federal government have passed laws against hate? A hate crime is generally defined as an act of violence, harassment or oppression against a member of a certain class or group. Hate crimes as well as legislation enacted to compensate its victims gained national attention after the 1998 murder of Matthew Shepard, a gay student at Laramie, Wyoming.
Being a civil rights lawyer with fifteen years experience under my belt, I never imagined I would become the victim of a hate crime, at least not by the federal watchdog agency funded to protect my civil rights. Yet that is the scenario which began to unfold when I was denied access to the federally-funded Computer Lab at the community college where I was both a student and Legal Research and Writing instructor. In the previous fifteen years, no student had filed a complaint against me, nor had I been disciplined by the State Bar of California. Through a breach of patient-physician confidentiality, women at the college learned I had been diagnosed with a chemical imbalance-related illness and said they were afraid to be in the same room with me.

Crimes is the factor that every one hates and criminal take it as their work but they dont thing that what the situation can be their if any crime being done by them.
