I was coming out of my apartment complex and slipped off wet grass on my back.Till today my back is in pain. The reason i walked through the grass area was because there was no walking pavement to the spot I had parked my car.Is the complex liable for not having a walking pavement in front of every parking spot here in texas?

Default Not sure

I do not think so as they could always point out that mother nature is at fault here [ fog/mist = wet grass] and not them, therefore as they did not make the grass wet, they are not liable to any fall that may have happened to you. Sorry if you do not like my reply but should you decide to file a case, you are bound to come across this argument.

While you may think hiring an attorney for a slip and fall accident is rather ridiculous, think of it this way -- if you fell and were injured due to someone else's negligence, then you are entitled to compensation. It's that simple.

Yes, but if you slip & fall due to your own negligence, you'll just have to keep working. You can try to find some case law, But, pretty much every inch of the earth is a potential hazard if it's raining. Now, if there was a water leak that the apts was aware of and neglected to repair timely or secure the area, you may have a case. I can assure you the complex had a walk area to the street, probably a longer walk to get to your car, but using the shortcut over the grass was your own negligence. Sorry.

I guess the walking pavement can not be a part of the pavement...you have to find that out first and then move ahead yes...you have a case.

I don't think there's a case. The nature isn't reason why you slip. There's no identity to sue (grass? mother earth?) if you yourself is negligent about this. But if you know there's someone negligent about this, then you are entitled for compensation. Or consult legal advice about this.
