Considered the European equivalent of Hatch Waxman the US law that allows patent extensions to compensate for time lost while a patented drug gains regulatory approval — SPCs act as a supplement to the patent’s protection by coming into force at the expiration date of the drugs patent. Thus, SPCs give the drug owner exclusive rights to market the drug for an additional period.
